Magistero e giurisprudenza rotale nel diritto matrimoniale canonico
Abstract
This study illustrates two factors which have contributed to the maturation of the canon law of marriage : the Magisterium, understood in its twofold task of describing the natural institution of marriage and of guiding the mission of the Church, and the law of the Tribunal of the Roman Rota, institution closely connected to the Roman Pontiff. The legal approach captures the ecclesial dimension of the exercise of precautious interpretation proper to the ecclesiastical tribunals.
